Employer won’t honour contract for Sunday work

    Hi there,

    I started a new job 2 weeks ago and signed a contract which states I get x amount of money per hour and double Sunday pay. I received my first payslip yesterday and there was no Sunday pay on it so I emailed HR and she said she made a mistake and sent me a new contract with no extra Sunday pay. I told her they need to pay me the extra for the Sundays I already worked as that was what the contract stated and she said she won’t even go there and it was a human error and it was just a template contract she used and got really nasty and rude about it. Can someone advise please ? I thought since this is a legal document signed by both parties they have to pay me for the worked time as per the contract and then they can terminate it and issue one from today on. Any advice would be much appreciated, thank you in advance!

    Force the issue and you might get paid the extra for your Sunday worked and it may well be your last pay cheque from them.

    It’s a case of weighing up how much you want the job against how much you want the extra few bob on a Sunday

    Was the extra Sunday pay one of the reasons for accepting the job or did it not factor into decision? Would not getting it make you struggle?

    I am pretty sure they will not be that forgiving when it came to your error. Written contract is what it is.

    Respect yourself, stand the ground, demand the payment as agreed and offer to sign an amendment going forward if that's ok with you.

    It did not factor into the decision and I can live without it but I feel like it’s unfair to disregard the contract for the past Sunday worked.

    I'd not be wanting to work in a place like this that haggles over what is probably under €100 especially as it was in the contract.

    Plenty of jobs out there.

    New job ASAP and wish them good luck for the future.

    Legaly they can't decide that you were issued the wrong contract and give you a paycut. But an employer who will try that will never be good to work for.
    If you can afford it be would be unavailable for Sunday work. but look for a new job they are not going to pay you and you will never be happy.
    Don't sign the new contract.

    You can make a claim for non payment to the Rights Commissioner (?) up to 6 months of leaving the job.

    I'd put a claim in and look for a new job straight away. If something like this has started at the start of your employment imagine what's further down the road.

    Just one question though - during interview or any other discussion on pay was double pay on Sunday mentioned?

    If not, and other aspects of pay was discussed, then maybe it is a clerical error, but they should still make amends as it was their error.

    Also make sure you keep your original contract plus the new one they made up and payslips etc as proof

    Double pay wasn’t mentioned at the interview, I got really happy when I saw it on the contract. I honestly do believe it was a clerical error and they have every right to terminate the contract now but I worked that Sunday on certain terms, I didn’t know then it was a mistake and it feels unfair and also the way they treated me when I pointed it out was very rude and disrespectful

    Yeah I think I’m done with them, I know I will easily find a new job, they need me way more than I need them at the moment. I’ll look up how to make a claim online!
