VAT claim on forfeited deposit , changes?

    Guys just to confirm-


    If I retain the deposit after customer cancels the whole job, the whole amount including the VAT becomes out of scope of VAT supply and I claim the VAT back ( meeting some conditions off course):

    Deposit charged =100 + VAT@1.135= €113.5

    Transaction cancelled by the customer :

    out of scope VAT supply €113.5
    VAT claim €13.5

    Am I right and was there any changes made to it by the Revenue ? ( UK did make changes from 1 March 2019)
