Penalty points Northern Ireland

    Wife was in Derry got stopped by psni for use of her phone wile driving.
    Told she would get a fine in the post and will get 3 penalty points.
    She didn't have her license with her so they want her to send them her licence once the fixed penalty and fine is posted.

    1. Can the PSNI put points on a foreign licence?
    I was under the impression they cannot. I understand they can keep their own count if they wish but points are not yet transferable..

    Anyone know what needs to be done here?

    Yes PSNI can add points here but Gardai cannot add points to the Northern licence holders or cars, it's the system.

    Can you show me the legislation for that?

    Everything I've read suggests otherwise unless it came in recently?

    "Mutual recognition of penalty points between the UK, Northern Ireland and the Isle of Man already exists. The North South Ministerial Council are examining the recognition of penalty points between Northern Ireland and Ireland."

    This is from citizens advice website.

    So I know it was something they had been working on but it had not yet been introduced.

    Doesn't say anything about NI though, but it does state that points won't follow.

    The system for PP is different.
    I think in Ireland they are automatically assigned to your licence.
    In NI you physically need to have it sent to the Fixed Penalty Office and they put it on, but they can have your licence according to the site for up to 12 weeks...

    I think i’d be “forgetting” to send my licence to see what happens, i mean what’s the worst thing that can happen

    I called the fixed penalty office, basically told its a great area, they take the licence create a shadow UK licence to try and keep track of you in the north.

    The gray area is it's illegal in the state to drive without physically having you licence on you and you could receive penalty point for not having it.

    So in order to comply with law in NI you need to break the rules in Ireland. He just said "Yeah, that's it, they have been trying to iron this issue out now for a while"....

    Not related but getting new car in a few weeks...
