overbearing Shed

    Our neighbour is building a large shed? make of double blocks and foam board insul. right against boundary wall..

    Our house front, faces their gable end side of house with a boundary panel fence from the back of their house to the front of our house and our side gate..at the moment it is a standard 3 and a half blocks higher than the 6 ft fence panel with what is said by builder a flat roof going on top..

    so basically we will have a high shed to the left and also facing their gable wall.. surely this is outside the normal planning exempt rules..?

    As it is if they do any further woodwork on the outside of brick, the fence panel will not be removable for replacement

    I think so, the blockwork is 9ft high , a couple of inches from panel fence. But my issue is that if I go out the front door and face left, I see the shed as in, its to the front of our house

    Unfortunately, the exempted regulations apply to the site in question. The front of yours has no relevance once its to the rear of their building.

    I think they only thing you can hope for here, is that they render the gable end nicely, and I would even offer to let them into your site to allow it to happen, otherwise, its you that's looking at the ugly blockwork going forward.

    Thanks kceire, not the gable end but the 5 mtr long end..
    they recently got pp to build a 243sq mtr house on a piece of land, but they have decided too expensive so they decide to convert attic and replace steel shed with the double blocked outer-shed fully insulated, even the concrete floor is insulated.. non habited it will be, i don’t think in the end,

    They are legally allowed to use it for habitation in sofar as home office, games room, study, hobby room, but cannot sleep in it.

    Does a extension that was built after they bought house count to the space allowed for the shed/building plus attic conversion that is not for habitation but is getting stairs built and velux windows?
    When talking to the builder, he was under impression that extension was built as same time as house..
    The length of shed/building is nearly the whole length of the space in front of our house on left hand side bar a a couple of meters at the far end.. my feeling is that the value of our house has been reduced

    • Extension has its owns exemptions.
    • Attic conversion is exempt, so are velux in rear roof space.
    • Shed has its own exemptions.

    There needs to be a certain area of garden left. If you cannot measure yourself, just lodge an official complaint to the Planning Enforcement section of your Council and they will investigate.

    So in other words someone can increase the floor area by 50% with no pp..
    And to the detriment of other properties..
    Does the shed/building not have to have the same wall finish and roof finish as the house if the shed building is front facing ie not to rear of house?
    I think there is 50% of garden still left..oh well...But I do know there are at least 3 other houses in the estate with 20%-0% space left of rear garden space and no pp sought..but that's another story

    But they didn’t increase the house floor area by 50% did they?

    The house exemption is 40Sq. M.
    The shed is 25Sq. M.

    They can do both once they comply with a few other of the exemption conditions such as private open space, heights and finishes.

    The d/s .. of unextended house is 46.5 Sq mtrs which is same as our one.
    As in total flr area is 1000Sq ft..
    Anyways thanks for your reply's and lets hope they put a finish on the building above fence line facing us ie facing the front
    Oh before I go, the woman next door asked me was it ok yo put her car in front of her house.. she cant do that without pp as she needs to put in lower kerb on footpath and that's council area.. lets see if she tries it..

    You don’t need planning to lower the kerb. That’s something the council will do and charge you for. But, you do need planning to create or alter a vehicular entrance in the boundary wall/fence.

    They are now putting new windows into front of house..

    Re above, by them putting a parking spot in front of house is contrariety to the other terraced houses in the estate, and by doing so hinders the proper parking places
