Can a car be sold "as seen" in a private sale?

    Can't find reference to this but we are thinking of selling a 2010 Picasso privately as I think we can get substantially more by doing so than the garage are offering as a trade-in. The car is currently driven every day. My question is in view of its age can it be sold as seen without warranty or are we liable or does the buyer have any comeback against us should anything go wrong after it is sold? Thanks in advance

    All private sales come with an "out the gate" warranty,

    As in - soon as the car's out the gate, the warranty is over.


    However, if you have deliberately mislead the buyer about a fault/issue you may become liable but it would be extremely difficult to prove on their part.

    As far as I know there is no come back from selling privately. You are not part of the motor trade so it can not be assumed you would have the knowledge of any potential problems the car may face.
    That said the person you sell to Will have your contact details & maybe even know your address so if there are problems they could come back to you. There would be nothing legally they could do though.
    You may be surprised how hard it can be to sell privately though & the low ball offers you'll get. Can't hurt to try if your in no rush but don't be expecting top $

    All private sales are sold as seen so there is no comeback apart from a dangerous fault, but proving that the previous owner was aware is difficult and in Ireland it's not worthwhile chasing low value debt.

    If selling get a burner SIM for the sale and then dump it. While there's no comeback with a private sale some people don't know or care and will hound you.

    A 2010 Picasso seems to be worth around €3,200. What are the garage offering you? Given your level of uncertainty about selling privately, I doubt the difference is going to be that substantial, once you take into account the hassle factor..

    Go meet them in a local petrol station or something, if you sell from your house I think they have more of a case against you.
    2 people I know have taken people on over a serious fault that wasn't disclosed. Just be honest in your price and with the buyer and there will be no comeback.

    The onus is on the buyer to check the car.

    Should, not will. There isn't a fleet of local mechanics around just awaiting your call.
