Expired licence and delay in new one

    Quick question,

My learner permit expired recently (partly my fault for not checking - but also got no letter/text/email), I applied before it expired to renew it, they said 5-8 working days which would have meant I was only 3 days without a licence. However I’ve been waiting two weeks now, they just say they’ve delays. The NDLS took the soon to be expired license.

I’ve a test coming up shortly so really need to be practising. I haven’t driven without the license as I’m very wary about whether I’m legal or covered etc. I’ve has lots of people tell me the receipt is fine or that the license is issued so I’m fine to drive (even a Garda!) but I’m terrified I’d be asked for license before I have it in my possession. Am I right not to drive?

The NDLS typically send a text message once the licence or permit is dispatched, there is no obligation on them whatsoever to inform you of the expiry of the permit/licence either, that falls on your shoulders.

It’s grand one guard telling you that, you could rock up to a checkpoint or get pulled over and a different guard might have different ideas. Just remember if you are caught driving alone the car can be seized, also they can tell fairly quickly whether you hold a licence or a permit by using handheld technology.

Thanks. Just to clarify, I meant driving as in still being accompanied by someone with a full licence. I know the onus is on me with regards checking it, more blaming the NDLS on the delay. I’ve been told it’s issued, still haven’t driven yet.

If the NDLS say it is issued then a valid permit is in force, therefore you could drive accompanied, it would be upto the garda at a checkpoint or who stops you as to how they wish to proceed, usually it is dealt with by way of production at a garda station of your choice within 10 days, however the law clearly states you are obliged to carry it with you at all times when driving.

If the NDLS have issued it and they have confirmed this to you but you still have not received it then the delay is with An Post, and they don't have a tracking system available for licences/permits issued so all you can do is play the waiting game, anything over 2/3 weeks i'd be reporting it as lost/stolen to the gardai and alas the process of going back to the NDLS has to happen again along with the relevant fee for a duplicate.

This is what my instructor told me when I was about to start my lessons. Back in January, I had my lessons scheduled to begin 2 weeks after I had applied for my learner permit renewal. The first lesson was on a Sunday and I received the text about the permit being dispatched just 2 days before on Friday. No way was I going to receive the permit in the post before the lesson. So I got on to my instructor asking to reschedule to the following week. He said I was okay to start the lessons, since I should be able to produce it at a garda station if stopped. I received it 2 days after my first lesson.

OP, when you say "I’ve been told it’s issued", do you mean you've received a text from NDLS?
