Sold car with logbook

    Hey all,

    First time poster here! I have a bit of an issue at the moment. I recently sold my old car but foolishly let him send off the log book. Low and behold an e-toll charge came in the post and I've rang him twice which he replies that its been posted. I rang the dept of transport in shannon, they said they are up to date with everything on there end of things and cannot declare it sold because I don't have his details ( sold it through facebook marketplace so only have his number). I've got myself into a silly mess and feel stupid for doing so!! Anyone have any advice? It would be very much appreciated. Thanks in advance.

    Check on motortax.ie for vehicle change of ownership https://www.motortax.ie/OMT/changeOwnership.do

    You could request another logbook and it will come to your address and then fill it in and register it to him backdating to date of sale depending on how long ago that was.

    Yeah I've checked a few times and still no change unfortunately! I don't have his details so I couldn't register it in his name.

    Thanks for the reply. It was ten days ago now, I'm hoping it's just a delay but I'm not holding my breath! Unfortunately on Facebook marketplace the buyer's message disappears believe it or not! The form I have requires a name and address from the buyer which I don't have.

    If it was only 10 days ago, I wouldn't be panicking yet. If you sold it on the weekend, it's only been around 6 working days, if he posted it on the Monday. I'd give it another week or so.

    I doubt falsely reporting a crime would do the OP any favours with the authorities. The OP sold the car and was paid in full so it wasn't stolen.

    This is a route I would like to avoid haha. My fear is that any speeding fines, parking tickets, toll charges etc will come my way if he hasn't sent it off and I haven't a leg to stand on!

    I’m assuming that if he wants to insure the car, he needs to have the log book in his own name. Otherwise he is driving the car uninsured.

    I wouldn't wait, just apply for a replacement immediately. If the transfer happens meanwhile, all is well.

    Just to give you an idea...

    I sold a car on 2/4 and posted off the vrc on the 3/4. This is what motortax.ie says of it...

    Transferred to an Individual on: 02/04/2019
    Notified on: 04/04/2019
    Most recent Vehicle Registration Certificate issued on: 05/04/2019

    It all seems to happen quickly once they have the document. Don't hang about any longer....

    Thanks for the advice. I'm just wondering what I can do if I get the replacement logbook? Can I declare it off the road then? And if so, if the car is stopped for whatever reason will a fine/summons end up at my address?

    If the car has tax declare it off the road, he'll have to explain himself teh next time he's picked up by ANPR

    Tell Shannon the story and they can make a note on the system. It won't change ownership but at least it's flagged.

    Just an update on the current situation. I finally found the blokes full name and his facebook profile through an exhaustive search!! Seems to be a bit of a wheeler dealer so I'd imagine he's selling on the car and then post the logbook under the new owner's name. Either way I have solicitor who's going to contact him so I'll see what happens!

    Happens a lot. You can complete a statutory declaration confirming you are no longer the owner of the vehicle. Any solicitor can do this for you for about 10 euro. Department of Transport then just take your details off the vehicle.

    If you have his full name and address then request a replacement logbook from the motor tax office and then put his details on it and send it off to Shannon. He will receive the new logbook in his name and he can do what he likes then as the car will no longer be in your name.
