I’m currently getting the back to work family dividend (I’m in my second year of it). I will be going on maternity in May: does it stop when I’m getting maternity benefit? My local office have messed it up so many times at this stage (I was initially refused for it because they said time on a CE scheme didn’t count, then didn’t want to pay back pay, then stopped when I was getting illness benefit (I got that back too), then stopped after first year said I wasn’t entitled to second year), that I just don’t want to ask them.

You are entitled to keep the BTWFD while receiving Maternity Benefit.

Does anybody know if I can add a newborn to an existing back to work family dividend?

I am receiving this payment for 3 months for my 2 kids, however my wife gave birth to our third child yesterday.

My local intreo says I am not entitled to a review, but the guidelines states clearly that if there is any change in my circumstances the claim can be rewied.

I assume that you are referring to the following wording:-

Claim Maintenance and review of entitlement

Back to Work Family Dividend claims are reviewed at 12 months in order to determine a customer’s continuing entitlement. The rate in payment is adjusted down by 50% at this point.

Back to Work Family Dividend is subject to any appropriate budgetary changes.

Changes in circumstances, such as a reduction in the number of children payment is being made in respect of, may apply from the date of the change in circumstances.

If so, then those three paragraphs appear to be describing what happens during the 12 month review of entitlement. So it may be that when the review of entitlement takes place, they will identify the change in your circumstances and pay you accordingly, backdated to the date of the birth of your third child.

However, there's nothing to stop you from asking - in writing or email - for a review of entitlement on the basis of the change in your family circumstances - being sure to quote the bolded paragraph above in your correspondence.
