small claims court-clamping

    Hi,

    Posting for a friend.

    Had a valid ticket but it flipped over i guess when closed the door. So there was a ticket on the window but upside down.
    So paid the clamp and appealed. The ticket can be seen from the pictures the clamper took. Submitted the ticket so show proof the ticket was valid.
    Well claim was denied.

    Would the small claims court to use to get the money back?

    Small claims won't take the case.

    NTA are the appeals body after an initial appeal to the clampers as far as I know.

    The NTA have an appeals process if your appeal to the clamper was unsuccessful.

    According to the IT today 40% of appeals are refunded.

    I should mention the clamper were apcoa so private company if that affects what you said.

    Private clamping is regulated since Shane Ross commenced the legislation a few years ago; so its all under the NTA.

    Chance of success is relatively low if the ticket wasn't on view, as there's no real way to show that the ticket actually 'belonged' to that car, but I believe the process is free at least.
