Commens on legal settled offered would be appreciated

    Hi! I have been offered a legal settlement for a horrendous renovation project on our house, which saw us have to pay 75k in remedial work, plus 2.5 years of legal stress, and worrying about college fees for daughter as savings depleted due to remedial works. A report said our house was devalued by 60k despite the remedial work just because of the history of the house.

    Today, I got offered a settlement of 70k - 10k was for stress. I produced all the receipts, but that is all they were offering. My solicitor thought about 150k initially, as the original engineer, made so many mistakes from the contract he gave me, to planning mistakes, through the house not being able to go through BCAR due to his mistakes, through to poor design and the need for structural supports. The original engineer was suspended from his professional body for a year.

    The builder is broke apparently, and the engineer's insurance company are saying that they will lodge a tender in court of 80k - they have not even given in a Defence yet - and that if I get under this award in Court, after another 2 years, I will have to pay their legal costs from here on in, which could amount to 50k.

    My solicitor and barrister, though saying I could get a lot more, seem to be urging me to take this sum of 70/75k, or near it now. The sum is plus costs. Does anyone know about this tendering stuff or been in this sitaution previously.

    Would welcome some comment on what this all means, and what people's own perspective on it would be.

    Sorry, we cannot give legal advice here
    I accept that you have gone thru' a harrowing process and that it is a complicated matter.
    Even those with knowledge and experience of this sort of litigation could not [possibly advise you properly without studying all the relevant pleadings ad reports. That is not possible on a discussion board.
    You have advice from your own solicitor and barrister who will have studied all relevant information. They will also have formed a view as to how your evidence and that of your experts will run. They may also know which judge will be dealing with the case.
    They are in a far better position to advise you than anyone posting here.
