found with drugs

    So basically due to a number of personal factors, notwithstanding sheer stupidity, I got myself into dealing drugs last year.

    A few days before Christmas I was apprehended by plainclothes Gardaí and taken to the station where they found 7 grams of cocaine in individual grams. My house was raided shortly after but all they found was dozens of empty baggies in my room, a product of my heavy coke habit. They questioned me for an hour afterwards and it was very amicable, I wasn’t the guy they had been looking for and it was sheer chance they caught me. I spoke to a solicitor on the phone in there and he spoke to the guard who detained me, and both of them said that I should make full admissions to dealing the coke, and both the guard and solicitor assured me I would be looking at a 1.1 probation, meaning I wouldn’t be recorded as having a conviction. I followed their advice and made full admissions. It’s been 3 months and I’ve yet to be formally charged with anything.

    Can anyone advise me on whether what they told me is a realistic scenario? I went to a solicitor a few weeks ago who told me I would be lucky not to be jailed, yet the other solicitor is still confident he will get me 1.1?
    I have no previous convictions and no trouble previously except for a JLO when I was 13.

    Sorry you are going to have to take this up with your solicitor.

    It depends on the Guarda report. The quantity. How the DPP direct a charge and the attitude of the Judge on the day.

    Yeah that’s basically what everyone has said to me, my one saving grace is that the local judge is known for giving second chances if he thinks the person up before him made a mistake, but the joys of our judicial system means if the person up before me pisses him off he could throw the book at me.
    It’s the not knowing that is destroying me, the longer this is going on the more my head is getting messed up. I also know that these sort of cases can drag on for months as well because of adjournments, but I’m hoping the admission will fast track the process.

    I dont think this really is a forum that can help you.

    No one here has any answers and I think you will need support from people around who arent going to judge you.

    You are a kid, you made a mistake and you will have to take the consequences of that.

    I would probably work off the fact you are likely to be convicted and it is up to the Judge whether to apply probation or a custodial sentence.

    You simply wont know until the day and thats the truth of it.

    I would speak to a counsellor and maybe check out the personal issues forum who have a lot of resources there.

    I expect a Mod will be along to lock this thread.
