    Following consultations with a Mod & CMod in the roads thread it was felt best that as the judicial review is currently adjourned to April 4th 2019 the matter is best discussed in the legal discussion forum.

    The M28 Motorway thread was closed as a result of the current legal proceedings and i contacted the Mod requesting the CMod review as i felt that even with the proceedings currently adjourned there are still discussions that can be had while adhering to the legal process.

    I attach the quote received from the CMod via PM and also a link to the original thread.
    Hi guys,
    The main interest in this closed thread is now "awaiting news of the judicial review... Now that some news has emanated from the hearing we can go on that while still being legally compliant." Perhaps this would be a grand time for Cork Trucker to open a new thread in Legal Discussions forum, where there is a audience that discusses legal issues, and has a strong interest accordingly? That would be my recommendation.

    The M28 Motorway thread was closed as a result of the current legal proceedings and i contacted the Mod requesting the CMod review as i felt that even with the proceedings currently adjourned there are still discussions that can be had while adhering to the legal process.

    There are bigger issues regarding on going cases than simply discussion the issue still standing.

    Sub judice is the issue which prevents pretty much any discussion in any thread on any point on the matter, though it is debatable how far the rule will apply in a non jury judge only case such as a JR.

    Thank you to nuac for reopening the thread.

    As some of you may or may not be aware the judicial review proceedings were brought to an end today with only the judgement to come, this is to be expected in the next 6 weeks is my understanding, i remain hopeful that Justice McGrath won't refer the matter back to ABP and allow it to proceed as it is a badly needed piece of infrastructure, not just for Cork but the southern region as a whole.

    Suggestions by the objectors that the road by re-routed via the N40 onto the Kinsale Road Roundabout and up the N27 Airport Road and back around via the Ballygarvan to Carrigaline R613 is completely impractical, in doing so would deter regular and port traffic from using it.

    As a truck driver who uses the N28 on a 4/5 day working week the current setup is far from suitable both for current and future generations.

    Any thoughts welcome

    The function of a judicial review is not to choose a route or decide the merits of 2 alternative routes. All it does is examine the process by which the impugned decision was reached.
