Has anyone actually had experience.of taking a claim for injuries in an accident?

    I know lots of people have opinions on how it could or should be done but has anyone here actually had personal experience.of putting in a claim.for.(legutimate) (arm & shoulder) injuries all logged with the hospital & doctor from a (bus)crash? How long should.you wait, does a solicitor have to.organise seperate medical report/visits etc ^ if the injury has not healed how can you claim when the damage is not yet resoived and future problems may occour?Many thanks.Itss only been a few weeka. No cctv.but I am sure the bus has internal cctv that wouod have picked it up.I have the bus reg & time.

    Speak to a solicitor. They can advise you on your specifics.

    There is no general answer. Only specifics and you will require legal guidance for that.

    What about the picb? Is that the normal route - costs only e45 and no solucitor required - anyone had experience with that? Thanks.

    You need to put the bus operator on notice, preferably as soon as possible. You need to formalise (but not finalise) the claim within 2 years of the event.

    You could talk to a solicitor on the basis of just one consultation and still proceed via the PIAB.

    All right for small simple claims but perilous for more complicated claims. If there is potential for injuries to worsen it is inappropriate and if there is future impairment of earnings involved, forget it.

    Any personal injuries litigation apart from medical negligence cases must be submitted through the PIAB initially. Honestly speak to a solicitor to at least get an understanding of the process.

    If you dont have a solicitor the insurers will turn you inside out and low ball you. How do you know what is a good offer? Do you have a network of medical experts to commission medico legal reports. Do you know anything about the statute of limitations or caustion or joining third parties?

    Get a solicitor. Know their cost.

    Don't use one- you will learn their worth the hard way.

    You can't DIY law. Even Lawyers get it wrong on occassion but when they do you can sue their insurance. You can't sue yourself if you screw up.

    Don't want to get too specific but I was a claimant in an rta incident a few years back, waited about a year for things to settle and initially went directly to the insurer to discuss. I had a few people I knew in the industry and had a general idea of a figure. Once they were aware I was self representing I think they offered less than half of the general figure and wouldn't budge.

    In the end I was given the name of a solicitor who sorted it out in a few months and it was a much fairer amount. They were able to advise me and had much more experience in dealing with the company. It's not even a knowledge thing, the insurer most likely knows the solicitor you have so they know they can't take the piss with them. If you go in solo they have an immediate advantage of their knowledge and experience.

    Good points made by all there -thank you. I'll take yiur advice and see if I can find a decent solicitor. I now have 4 doctors medical reports & am back in the hospital next week - seems like it will be a long recovery & have some traction as a claim & significant damage done. Any help or recommendations on solicitors or how to choose would be most welcome.

    Solicitor recommendations contrary to forum rules
    There are a number of firms who specialise in Med Neg cases. Most solicitors would be able to point you in the right direction
