trade union exempt from collective bargaining, if not a member of ictu

    hi all
    Firstly apologies if this is the wrong forum, mods feel free to move.
    Quick question does anybody know if a trade union is exempt from collective bargaining, if not a member of ictu?
    I heard recently of a case where a group of employees joined a new union not recognised by the employer as the employer has already got other unions that they collectively deal with.

    However this new union is not a member of ictu and apparently this makes them exempt from collective bargaining, thus meaning any employee who is a member of the new union outside of the collective bargaining structure, would not be affected by any agreement reached by the employer and the unions involved with the collective bargaining structure?

    If this is the case can anyone point me to the legislation that states this?
