is it legal to take photographs inside a court building but outside the court room

    and if it is..or indeed isn't would it also be legal to take a photograph of a section of the order of court pictured on TV Screens outside court halls & publish it on social media?

    just saw someone do it today

    struck me as a dodgy thing to do anyway

    Or does "Includes" mean excludes anything not listed after?

    Is a photograph defined?

    How does 13.a.(iii) or (iv) meet the requirements of article 40.3.2? It seems to allow exproriation of private property?

    The practice direction has the definition. What do you mean by "full definition"? Do you mean exhaustive?

    If the PD says "includes", then the words "this is not an exhaustive list" should be read in. I would also note that it says "or other similar device", so even though certain devices are listed in a non-exhaustive list, there is a broad brush measure to ensure any device is captured by the ban.

    There isn't an interpretive provision for "photograph" in the same way there isn't an interpretive provision for most of the words in the direction - there is no inherent ambiguity and everyone understands what is meant by it.

    I think this is overstating it but just to play ball, there are numerous personal and other rights contained in the Constitution and sometimes these compete with one another. Where rights compete, certain rights become subordinate to others. In this case, the right to a fair trial (or, frankly, any number of other rights) trumps the right not to have your mobile phone temporarily confiscated.
