Injury claim

    Hi there, I hope you can alleviate some of my anxiety. I put in an personal injury claim 3 yrs ago against my employer. I fell off a swivel chair in my classroom ,28 children and teacher seen my accident, i banged my head and have had medical problems ever since. I met the engineers on both sides, i wasnt prepared for the questions and my boss was was in the room also so i felt abit intimidated and nervous. I've have been told by my engineer that my report doesn't look good. I'm at my wits end and feel like they are making me out to b lying. I don't know what to do or what's gonna happen to my case now.     How did you fall off the chair? Was there a fault with it?

    If th engineer says your claim doesn't look good then I don't know what you're looking for here!

    What on earth makes you think your employer is responsible for you falling off a chair :confused:

    Jesus, I can't believe your employer wasn't there to hold the chair for you and every time you went to sit down on the chair.
    Its a disgrace , you don't need a solicitor by the way, it's done get ready to count your money (if you can count, maybe get your employer to do that for you too).

    On what grounds are you claiming?

    The chair was faulty? It shouldn't have had wheels?

    I've a swivel chair and if I fell off it. It would be tough **** on me. How is my employer responsible for that?

    Am I missing something?

    Was your employer negligent though, or was there some sort of defect with the chair that caused you to fall?

    Just because you fell and suffered an injury, doesn't mean you are entitled to compensation.

    But i'm still not seeing how you falling off your chair was your employers fault.

    What was wrong with the chair. Did the person who determined the fault with the chair write a report on their findings? Maybe your claim should be against the manufacturer of the chair?

    That seems unlikely, is this what the engineers report found? Ultimately, unless you can show negligence or that the chair was faulty etc, then you'll struggle with the PI claim, sometimes things happen and no one is at fault.

    Back to the your OP, it could be found that you are 100% telling the truth and you still get nothing, the 2 do not necessarily go hand in hand.

    It's the employer's responsibiliy to provide a safe system of work. So if there is something wrong with the chair, the employer shouldn't have provided it. Even if there was nothing wrong with the chair, but it was just not the appropriate chair for the situation, the employer still has a problem.

    OP, I get that you are anxious about the progress and likely outcome of your claim. But there really isn't enough information in your post for us to say anthing very helpful. You say that you fear "they are making me out to be lying", but it's not the job of engineers to make judgments about whether people are lying or not; they are there to express opinions about the physica aspects of the accident - the condition of the chair; its fitness for purpose; the way the accident unfolded, etc.

    And you say that your engineer has told you that your report "doesn't look good". Since we have no idea why it doesn't look good there isn;t a great deal we can say about this, but if this is an engineer's report then it may be saying things like the chair was not broken or defective, or was not the wrong chair to have used in the circumstances. It is very very unlikely that they are saying anything to question your honesty and, whatever the report does say, your solicitor will advise you on whether it is helpful or harmful to your case.
