VAT on work done

I got some work done early last year at the time the person wasn't vat registered and sent an invoice at the time with no vat.

In the interim they say they have registered for vat and I must now pay that (no amount from the invoice was ever paid until now pending some remedial work which is all sorted now)

Is that correct or does vat go from invoice not payment date?

I'm assuming that they are in the construction industry....and that they pay VAT on their receipts rather than their invoices.

Regardless, they didn't charge you VAT so you just have to pay what was on the invoice.

    Thanks for the reply.

Are there any actual "rules" on this do you know? The invoice is plain as day but it's almost a year old and we could both apportion blame to each other for that.

Adding VAT adds four figures so I want to be certain of my facts if I decided to dispute this. I have one invoice that was sent initially and one that was sent when I agreed to pay following the remedial work. Both are the same amount and same job but the later has vat added

its a tricky one. . the contracter is only colecting vat on behalf of revenue. so in esence its seperate to the initial invoice.
my accontant made sure to get me to have all my invoices paid up before i went vat registered or else i would be liable to pay it . if its billable to me then surely that cost has to be passed on.

best bet is to ring revenue and ask. they will tell you

The VAT inclusive act of 79? States the price to the end consumer must include VAT.

the first invoice has no vat becasue it wasnt due on it . the second has it becasue it is now due

i think it would boil down to whether it is a new invoice or a reissue of the old one. if its new then vat is applicable

It might also hinge on if he is running his business on cash receipts basis or using accrual accounting.

OP: can you interest him in HRI?
