copy of a statement made against me

    Somebody made a statement to the gardai about me. The allegations were absolutely false and I have proven this. The gardai are now considering taking a case against the person who made the statement for making a false statement.

    Am I entitled to get a copy of the original statement that was made against me?

    No not while criminal proceedings are being considered, you won’t see a copy of it. If a person has made a false statement the offence is against the “state” as such, though you may be required as a witness. You may seek a copy of it when the criminal proceedings are complete if you wish to take a civil claim.

    He said he wanted a copy.
