Annual leave question

    Hi all,

    My company has been taken over by a larger one, annual leave was always 25 days holidays for a permanent employee. When the acquisition happened the allowance was made to keep the 25 despite the rest of the organisation only starting off with 20 and after many years service they would eventually get to 25 days AL.

    Is it possible for them to remove the "excess" holidays that we have, despite it being in our contracts?

    What excess holidays?. You had 25 days. You say your allowance is still 25 days.

    What am I missing here?

    The extra 5 days.

    The OP is asking if it will be possible for the new owners to put all employees onto 20 days annual leave.

    The answer OP is that it depends on (a) the terms of the take over and (b) all contracts are open to negotiation so they may try it down the line.

    The last place I worked in suffered a takeover and they instituted an illegal pay cut, as in, they simply cut pay by a percentage with no negotiation.

    I would have thought that under TUPE holiday entitlement is protected, and for any changes to made the employee would have to agree.

    It would require a contract change which you would need to agree to.

    Why would you agree to fewer holiday days?

    Indeed but the reality is that companies get away with doing things that are illegal.
