FOI on Gardai

    Hi,

    Will a freedom of info act application for the footage taken of me by a security guard on his body cam and phone be successful? I want to see and have a record of the images taken of me.

    I have date, time, name of guard and a video recording of the incident

    Gardaí don't have or use body cameras at present so I don't see how you would get that footage?

    If it ends up in court, you solicitor might be allowed ask for any footage.

    But I'm glad you got a kick out of it. I'm here to amuse.

    Afaik foi doesn’t apply here. You’re just requesting to see video footage which contains your personal data, which they are required to do according to GDPR.

    As for who you apply to, I have no idea.

    The Gardaí have to apply for it as along with your personal data it'll also have personal data of others and that can't be shown to you. There's also a good chance it's been deleted already.

    Foi applies to government bodies. Security guards are not government employees.
    GDPR applies but only if they still retain the footage.
