Going to America for 80 days

    Hey all
    I am on a dissibilty allowance payment of 198.00,euro a week payed electronic to my bank account each week, and I am going on holiday for 80 days in New york, will the DA still pay this when I'm abroad and do I have to notify them of my vacation

    It will be stopped, or worse if you didn't inform them and they had to discover it themselves.

    But think about it, what's wrong with pausing the payment while you are over there? 198 euro per week is a lot of money and the State have been good enough to support you week in week out to date. There are others in the country who need support, that's the logic.

    Disability Allowance can be paid if you are studying an approved course outside the State under the Back to Education Allowance scheme or getting medical treatment not available in Ireland. You must notify the Department and provide proof of medical treatment or education abroad. Under legislation you have no entitlement to be paid Disability Allowance while on holiday. However, in practice Disability Allowance may be paid for 2-3 weeks while you are on holiday abroad. You should inform the Department of Employment Affairs and Social Protection before you go on holiday.

    OP, it seems you want people to advise you on the situation. Not informing the Department of your holiday and continuing to receive the payment means you are in essence committing welfare fraud. No one on this forum is going to tell you that is the correct course of action.

    When you accepted Disabilty you agreed to let them know if there was a change in your circumstances.
    If you don’t let them know that you’re leaving for nearly 3 months then you’re breaking that agreement.
    When they discover that you were gone your payment will be suspended. There will be a huge investigation into your whole claim which will go on for months indefinitely in which period you won’t have any payment and you really don’t want all this hassle so just let them know and accept that you can’t have DA while your abroad.

    All you need to know is that you thought through this for one afternoon, and made a few posts on this forum. The Department on the other hand are dealing with this day in day out long before you were even born. Do you think you are the only one who thought they'd come up with a genius plan?

    Even the lump sum could be an issue. Sounds like you get 200 a week you don't even need, but you'll take it, why not, you're entitled to it on paper. Only in Ireland.

    To be honest it seems every week is a holiday and you still get the money, how is leaving the country and doing nothing any different than being in the country and doing nothing.

    No, stupidly. You're thinking of Illness Benefit where certs are required to be sent on a regular basis in order to receive the payment.

    I do think a regular assessment period for DA would be a good idea though.

    Not quite - as per welfare.ie:
    To qualify for DA, you must:

    Have an injury, disease or physical or mental disability that has continued, or may be expected to continue, for at least one year
    As a result of this disability be substantially restricted in undertaking work that would otherwise be suitable for a person of your age, experience and qualifications
    Be aged between 16 and 66. When you reach 66 years of age you no longer qualify for DA, but you are assessed for a State pension.
    Satisfy a means test
    Satisfy the habitual residence condition.

    There's a rigourous (I'm told) process in order to receive it. Illness Benefit is for short-term illness, DA is for long-term.

    It should be mandatory.

    This guy was going to start a new job a month ago and was told he'd lose the DA. Guess he opted against it. Obviously, the DA claim is fraudulent if he was able to return to work

    People on benefit should be allowed to take holidays. Those people who resent a poor disabled man for going on holiday while not resenting the bankers and politicians are highly problematic.

    You haven't provided the initial poster with any practical advice by the way.

    People are allowed to take holidays, check the guidelines. It's two weeks per calendar year for recipients of a Jobseeker's Payment. For DA, as per citizens information:

    Under legislation you have no entitlement to be paid Disability Allowance while on holiday. However, in practice Disability Allowance may be paid for 2-3 weeks while you are on holiday abroad. You should inform the Department of Employment Affairs and Social Protection before you go on holiday.

    80 days is taking the absolute piss and to expect to be paid by the state for the entirety is what people are taking umbrage with.

    1. It's welfare fraud and the OP if discovered would lose their entitlement to the payment and have to pay back the arrears, also possibly receive a criminal conviction.

    2. As a taxpayer I don't want anyone being paid for an 80 day holiday outside the state. The OP has enough holidays while on DA.

    3. I'm bored of playing with you, ta-ra.

    Is there a way Welfare can find out about someone on disability leaving the country other than them being reported by someone? If there are, given how lax the laws are and the fact disability is paid straight into a person's bank (I think?) couldn't they just cross into NI and leave via Belfast to bypass any sort of checks in place by Welfare?



    People on DA could leave the country for god knows how long and still be getting paid every week. I'm sure there are people doing that.

    The question is, as OP put it, how would DSP know s/he was away for so long if there is no necessity to "sign on" and the benefit is lodged directly to the bank.
