Where did you buy it? If you bought it from China, European consumer rights won't be applicable etc.

Your rights? What rights? You may be allowed exchange it or given a refund if they're sound but you're not specifically entitled to anything unless you can prove some sort of defect, which I imagine would be hard enough with a ring. Doesn't hurt to ask though, although you will have to pay any difference in price.

As for resizing, it's entirely dependent on the ring.

I bought it in a jewellers here ..my issue is that the ring is clearly smaller than the ring i brought in for the measurement ..

Shouldn't be an issue with a local jewellers. Having said that did you not check yourself before you left the shop?

It was a surprise purchase so I only had access to the orginal ring for sizing briefly as i didnt want my girlfriend to notice it gone...
so when i went in to collect the new ring i didnt have the orginal ..
The new ring was then gift wrapped in the shop and only opened this morning ....
when my girlfriend tried it didnt fit and when you put it up against her orginal you can clearly see its smaller

As long as you can prove that, you should be fine. The item isn't as described.

Oh Congrats to ye OP!! Exciting times ahead... The shop should really resize the ring or give you a new one if that is what ye like. Pending on what it is made from and how thick the band is etc. I know the ring himself got for me, i wanted to get it slightly bigger as tis just what i like and the jeweller was great resized it for us but did say it would weaken the band as it was slim already
