Working another job while on work related stress leave

    Hi there,

    Without revealing too much personal information online, my work environment has become toxic due to one workplace bully.

    I feel that this person will eventually unravel themselves, but to protect my health and wellbeing, I need to take work related stress leave for the foreseeable.

    My company cover 3 days paid leave per year. After that they require that one applies for social welfare paid sick leave.

    My issue is that I want to do other work, there is a company I can pick up temping days with, I would be keen to do this while I am on my work related stress leave.

    As my sick leave is work related sick leave, I think legally I am allowed to do other work for another company.

    However if my based company insist I must apply for social welfare sick payment, does this payment allow the option to sign off on a day that you are working, especially as this is work related sick leave, connected to my based company.

    No. Illness Benefit doesn’t involve “signing on” so there is no signing off for any days.
    After 6 months on IB you can apply for PCB which if granted would allow you to work part time and get 1/2 IB.
    Also, sick leave is not allowed for in any part of Irish employment law, so you need to look to your contract about how your employer considers sick leave and you would be engaging a solicitor and not WRC if you feel your sick leave conditions are not being met.
    In short, nothing in Irish employment law states that someone on work related sick leave can work for another employer.
