JR - notice party options

    I’m involved in a planning dispute at the moment that has now gone all the way to judicial review. I’m pretty sure that a step was missed by the guy opposing me – I don’t want to get into specifics on the legislation as legal advice isn’t allowed but I think they should have sent me a copy of their application for leave. How do I raise the fact that they missed this step? Can I write a letter to the court?

    I'd get a solicitor involved if you're at the JR stage.

    I'm only a notice party because An Bord Pleanala made a decision on the planning matter. So it's between An Bord Pleanala and this guy but I still think a step was missed and would like to make that point.

    Even if you are a notice party there is nothing to stop you getting legal advice as to whether a step was skipped and how you should proceed.

    As Judicial Review is already under way you should as already advised get your own legal advice here.

    Before you close it, I was more looking for responses from people who may have been in the same situation in the past. Legal advice costs money so I want to go in there with some context and informed opinion to get most bang for my buck. Technically, I'm not an important player at JR stage- An Bord Pleanala is, and the other guy is. I'm just a notice party in all this. So maybe I could frame it like this - has anyone experienced a similar situation to the one described in my first post?

    Each case depends on its own facts - so even if it was allowed you cannot be advised here.
    If you consider yourself adversely affected you could write to the parties and attend the next hearing
