Friend looking to separate from Husband - any financial help?

    My friend and her husband rent a house. The landlord is selling next year. They live on a fairly modest income. She would like to separate. Can she apply for HAP as a separated person? Do they have to be legally separate?

    With rent being so high, I don’t think she will be able to get someone by herself and the kids. Any idea of options she might have from the social welfare. She works but at night, this will be difficult to continue as separated parent.

  • I’m fairly certain due to her being married she will have to be legally separated. As well as that to apply for HAP you need to be on the council housing list.

    No she won’t have to be legally seperated that’s not a condition of JSA or JSA Transition at all.

    Fair enough. But that still doesn’t help with the HAP situation. I’d tell your friend to apply for social housing ASAP OP. the faster she does the better.

    You shouldn't really give advice if your not actually aware of the facts first ,

    She will need an affidavit or solicitors letter declaring the are seperated to apply for council housing ,which if accepted then makes her eligible for Hap,but can take several weeks,someone i know just been through this.

    Will need legal proof of separation Im afraid. I was in the exact same situation and spent months trying to get help. She can apply for free legal aid (about a 9 month waiting list), I couldnt afford to wait so had to end up borrowing money to obtain a separation agreement from a solicitor. My very straight forward agreement still ended up costing €2500

    It may vary with differnt counties but my friend was ok with an affidavit for council stamped by a commissioner of oaths and with regards social welfare just had to state date of seperation and provide seperate proof of adresses.Athough both were already on socil welfare so that may be less complicated that just starting on it.
