    So..I had recently used a commercial internet service for my company..it didn't work as expected for me and I heard some dubious practice rumours so i cancelled..There was definitely some underhand terms..but anyway I had agreed to the unread(yes I know) terms. A few though stuck with me that I only saw after cancellation...and my bad experience...

    This is an EU company, do these terms look like they would potentially stand up in law? BTW I am not in any situation with them, just pure curiosity if terms like this would actually be enforceable

    • Furthermore if you harm XXXXX in the media your agree to be automatically to be charge a lump-sum of USD 10,000 for each instance and XXXXX can claim any damages to you, which could occour from Social Media, Email or Media in general caused by the customer.
    • If you signup for the Service and are representing a competitor or creating a competitor we can suspend the account immediately without notification and remain the subscription at the highest plan active until it is requested for cancellation. Furthermore we reserve the right to bill you a 10000 usd fee during the cancellation process and pursue legal action, you as a clone/competitor agrees to cover the legal fees.
    • If customer make a bad review and harm the reputation of XXXX, XXXXX reserve the right to bill the customer in the amount of $10,000 and seek financial redemption for each review committed, if customer make 2 negative reviews XXXXX can invoice the customer USD 20,000.

    The only EU directive I could see those possibly falling foul of is the unfair contact terms directive but to be honest they don't seem that unfair to me. You don't have to agree to them.

    One thing I'd say is that 'harm' is undefined and therefore a bit ambiguous..

    Didn't do anything..pure curiosity..but the English is terrible in there no doubt..they are under Danish law they say.

    Penalty clauses are unenforceable. Most of those clauses are penalty clauses.

    They wouldnt stand up.

    However it might not stop them taking your money if they have your payment details.

    NEVER order anything online from companies you dont know and without having read independently verified reviews
