Small Claims Court - Adding Penalties

    I’ve been waiting over 4 months for payment of an EU261 compensation claim from Ryanair for a delayed flight. I’m owed €250 and Ryanair have admitted that the payment is owed but have consistently failed to pay it. They’ve said it’s on the way and that it would be paid in 10 days, after that they claimed it would 28 days due to an error and now they’ve gone dark. On their website it says that each claim takes ten days to settle currently but as I said it’s been over 4 months. I’m at my wits end and I am considering small claims court. But I’m curious as to whether I could claim over the €250 as some form of penalty for failing to pay what is legally due to me under EU law. I know it’s unlikely but would really like to get one over on them for how unbearable a company they are. Thanks.

    Not a hope. You claim the 250 and that's it.

    You also can't add the court fee. So you'll end up with 230.

    TBH they'll ignore the Small Claims Court too so you'll have to get the Sheriff involved at additional cost.

    The fee for the sheriff is fixed at around 10 euro. They won't ignore him.

    They can and will, if the sheriff comes calling and no ones there he won’t be calling back. Small claims court will try their best to settle between both parties before the sheriff is sent though. Lots of claims are never settled through small claims court, the trouble with this case is the amount is so small they can ignore it.

    I was waiting over 6 months with Aer lingus. 4 months isn’t bad

    Thanks guys. Yeah I suppose the wait will just have to go on. Yep I’ve tried the aviation commission. Emailed them about 2 months ago. Didn’t get a response so request a call back. They’re only beginning to deal with cases from January they’re that stretched. It was them that suggested small claims court.
