They will presumably write to you and ask you to refund the amount of IB you received that you were not entitled to. I don't think they can take it from your wages without a court order. You could have enquired if you were eligible for Supplementary Welfare Allowance and if you were you would not have to refund if you were waiting on wages.

I thought illness benefit was for people who were out sick from a job they already had?

How did you start a new job if you were certified on illness benefit?

    Edit: I am correct

I was out sick the last year and my last employer wouldn’t take me back on so had to find another job

So you got fired while being on sick leave?

If so you shouldn't have been claiming illness benefit and should have changed to job seekers or another similar welfare.

This may cause issues for you with the social welfare and could be construed as fraud

Two weeks ago I went back to claim my job back.

BecUse of the buisiness of the job they had to hire someone else. And only told me recently , I was in a facility and I was sick so it isn’t fraud

Not true. I’m on illness benefit and went into it from being unemployed. It is not just for people who are working. As long as you have the credits from the relative tax year, and are unfit for work, you can claim it.

If he was sick during the period of unemployment he can claim illness benefit

Well then you should look into an unfair dismissal

But still you should contact the SW and clear it up with them

Ya well I don’t care because the line of work I’m in the don’t care about us and court cases wouldn’t be so easily looked upon.

They will look for it back, but they will probably give you the option of repaying it in installments over a period of time if you can’t afford to pay it all back at once. It’s not ideal, but you won’t be the first person who has done it.

Ah that’s ok I don’t mind paying it back of course.

Just as long as they don’t take all my first pay cheque
    Thanks for help

Welfare cannot deduct an overpayment from your wages, unless they get a court order to do it. What they normally do, if you don't go to their local office, is write to you outlining the nature & extent of the overpayment they made to you. They usually give you contact details so you can make arrangements to repay. You can agree an arrangement to repay by instalments, on their terms, of course. Usually the instalments are not that onerous. Good luck with it.

You do not have to be employed to claim illness benefit sexmag. You are completely mistaken. Why did you think that?
