Commercial landlord responsibilities?

    Hello all..

    I have a question I'm struggling to answer and hope for some help on here.. so heres the story..

    A tenant has rented a number of joined commercial units from a landlord for the last 4 years and uses them as a private school. The landlord to date out of goodwill has maintained the complete units, lights, paint, carpets etc.. The tenant now wants a section of the building to be made wheelchair accessable and also the addition of wheelchair toilets claiming that this is the responsibility of the landlord? Im not sure that it is as its a requirment of thier business.. Am I wrong? Also they want to reactivate a lift that has not been in use for the past 6 years and is not needed access is available via stairs to all areas and there is already another lift in the building that the landlord covers all costs for. The tenant wants the landlord to also take on the costs of the second lift.. appriciate any of your thoughts on this matter.

    The commercial landlord is under no obligation to do anything of the kind. If he is a commercial landlord he should be well able to pay for legal advice and should go and get a solicitor to draw up the standard full repairing and insuring lease not get himself involved in verbal agreements with regard to commercial premises.

    Depending on the age of the building, wheelchair access and lifts might be a building regulations requirement that the landlord can't get around.

    Is there planning permission and a fire safety certificate for use as a school?

    Its a bit of legacy agreement with a past landlord.. official lease is in the pipeline..

    Building is inspected annually by fire marshall..
