Help on Holiday calculation

    Need help on the following. I have 2 employees. John is full time working 39 hrs a week. He gets 20 days holidays a year. Jack is on a Fixed Term contract for next 12 months and only works 30 hrs a week. (6 hrs a day)

    Jack has come to me saying his holidays is 30x52 hrs times 8% =125 hrs
    125 /6 = 20.83 days. So jack feels he entitled to 20.83 days holidays

    But John works 39 hrs and his holiday hrs peaked at 155 hrs = 20 days.

    So ... John has the hump that he working extra 9 hrs a week and gets same holidays as Jack

    Is there a flaw in Jacks calculation???

    Ps.... asking for a friend!!!

    One has a shorter working day so his holiday days are shorter too. Its 20
    Short days instead of 17 standard days (for example)

    They both are entitled to 20 days unless you want to give them more.

    "Jack" is due 20 paid holiday days during the year, paid at 6 hours per holiday day. He is also due a paid day off for each of the 9 public holidays during the year, also at 6 hours per day.
    His calculation is flawed. The 8% method is usually used for part time workers who work irregular hours which is not the case with him. It is also calculated on hours worked. On a 1 year fixed term contract, you would expect someone to be off at least 29 days (5.8 weeks) during the year incl public holidays.
    30hrs x 46.2weeks x 8% = 111 hrs / 6 = 18.5 days holidays.
    As you can see he is better off going with 20 days holidays at 6 hours paid per day.

    Let's say they both on a salary basis and both get €25,000 a year.

    is it not unfair that John works extra 9 hrs a week for same pay and they both get same holidays. there has to be some differentiation in holidays in this case ... otherwise John should re- negotiate to drop back to 30 hrs IF he can hold his salary at €25k!!

    What has fairness got to do with It?
    Jack is paid 25k for 6 hours a day, John is paid 25k for 8 hours a day. Jack is better paid per hour worked.

    John can negotiate better conditions if he is able.

    John if you are being paid...… ooops, sorry, Masala, you are being paid €25k per year for a 39 hour week...…. oops sorry, its your employee isn't it :D.... ah sure g'won we know it's you ;) and jack is getting €25k for only a 30 hour week, well then that has nothing do with anything regarding your holidays. that is for anoter discussion and there may be endless reasons why it is different.

    but regarding your holidays
    so when you get a weeks holidays (5 of your 20 days), then you get paid for 39 hours.

    when jack gets his weeks holidays, (5 of his 20 days) then he gets paid for 30 hours.

    == there is your differentiation on holidays

    if any employee can re-negotiate their contract of employment and drop 9 hours work a week off it and keep their rate of pay then fair dues to them, but I doubt any employer is going to do that without damn good reason as that equates to basically a 25% pay increase.
