Advice on summons for failure to produce insurance

    Hi All,

    I was stopped at a checkpoint and was asked for insurance. I didnt have it on the car as I was on way home from work and the cert came in the post that day. I had a picture of the insurace disc my wife sent me and I showed the Guard. I asked the guard specifically if he wanted me to produce the documentation. He said no.

    Now 3 months on, I have a summons to attend court for not producing said insurance. I was fully insured on the date and time in question and will get a letter from the insurance company confirming that I was insured.

    All of this could have been avoided if he just told me to hand in the insurance. Can this be sorted out before the summons or will I have to show up in court, hand in the letter from insurance confirming I was insured and explain to the judge I specifically asked if he wanted it produced and he said no?

    I'm sure the prosecuting guard can deal with this if you contact him.

    If there is a summons you should contact the garda in advance and show him the insurance. Even if he says that he will take care of it, go to court and be sure.

    +1 At the very least, send someone to the court with the cert to show the Garda, even if you do it yourself before the court date. Don't worry, if you go to any traffic court, you'll see people (can be fathers, mothers, brothers etc. of the person summonsed) pulling gardai to one side to show them licence and/or insurance before the court starts, happens all the time.
