Deposit on new car but lost job

    Hi guys.

    So I'm just home now, got fired from my job.
    It's a family run company and I had a run in with the owner over my wages not been paid. Anyhow long story short I lost my job and il be taking them to court.

    Now I've an even bigger issue. I purchased a new car a few weeks ago it's due in this week or next week.
    I paid 500 euro deposit as well as signed finance papers and final agreed price papers
    Obviously I can't afford the car now or for the foreseeable future and I also understand I lose the deposit.
    Can I just cancel my order? The car is specd to how I want it but I just can't afford it anymore.

    Is it just as easy as ringing up and explaining or am I tied to the car or other fees ?

    Like I said it's due in this week or next.

    Sorry to hear about your job. It’s a job seekers market out there so hopefully you’ll get sorted.

    You can cancel the order, explain your situation and as you said the €500 will be gone. People cancel orders for cars sometimes for all kinds of reasons.

    I am sorry about your job....as said the job market is bouyant so hopefully if will work out. However I cannot help post this.

    I might do but like I said I hvnt had any wages the last few weeks and I have a child to provide for so it will take me a a few months to catch up assuming I don't get a job within a month. I would regret losing it but I can buy again my main worry is been in bad debt and ruining my credit

    Sign on, immediately.

    Speak to the dealership right after that. Just tell them what’s happening. They may be able to cancel the order/contract, take the car into stock, find another buyer or you could find a new job and continue with the purchase.

    Sign on now. Don’t delay.

    Call into the dealer. Don't phone, don't text, don't email.

    Tell them the truth and I reckon there's a decent chance due to the circumstances that they'll refund your deposit.

    I've been in a similar situation where I needed to cancel an ordered car and once I explained the situation, the dealer was very understanding. Even better if you're known to them, have bought cars previously, etc. i.e. the more genuine you are the better.

    Well I rang up the sales guy.
    He sounded pretty annoyed which I could understand. He said he can't give me my deposit back which is fair enough.

    Better then been in debt of 28k.

    I'm sure he's heard alot of excuses so he probably doesn't believe me.

    You should go into the dealer and say that to the sales guy that you never met him before not signed any paper work and if says otherwise say it's not your signature and a figment of your imagination, just like your story OP!

    Call into the garage, look for the dealer principal, explain story, mention that you have already asked salesman.

    Did you get anything saying deposit was non refundable? I know deposits exist for a reason, but I’m not certain that they have any legal right to keep it.

    Poor form by the salesman. If I was him I would return it and know that the day the OP gets back on his feet and finds a new job will be the day I pick up the sale again, followed by many more no doubt. What goes around comes around..

    I did specifically suggest you call in personally and not call, text, fax, email, snapchat etc.

    Your chance of reaching out to his human side has now gone.

    Yep, you be amazed how many people lose their job in between ordering and collecting a car. I had people try this within a few days of putting a deposit down.

    I had one lady do this in an unusual spec and colour (in a good way) automatic (it was in stock to be fair, she didn’t factory order it), there wasn’t much money in the deal, we were up against another dealer who wanted a sale at all costs, she was arguing over €20 kinda thing. Anyway, told her I had the car sitting there ready and would she do the deal. She did anyway.

    Few days later I got the whole sob story. Lost job etc, I gave her the deposit back anyway, no point in being a dick about it. Not an hour later get a call from another main dealer (her local one) looking for the car (dealers would routinely swap new cars for a colour or spec they needed)
    Told him it was sold! She ended up buying a Nissan instead :)



    Anyway OP, salespeople get this story all the time.

    OP says it was specced up to how they wanted it, so may not be an easy sell for the dealership - depends whether whatever was specified adds value to the car, or whether they were just options the OP wanted. In that case, I think losing the €500 deposit is fair enough - dealership may have to discount the options on the car to shift it now.

    Out of interest - what is the car? There's a huuuuge shortage of stock in pretty much everything at the moment so there's a better chance than ever of the dealer finding a buyer for the car.

    OK. Ask the dealer if they'll apply your E500 to a future purchase.

    If not, be sure to add the lost deposit to the cost of the claim against your previous employer - you mentioned you are taking them to Court.

    The thing is, that would never happen.

    The average retail consumer forgets a goodwill gesture around 5 seconds after they leave the premises and everything motors related is extremely fickle and boils completely down to price. They only remember negative interactions and they only remember these for long enough to give you a 1* Facebook review.

    The OP would get their €500 back and if this dealer was €10 dearer than another when they go to buy their next car, they will go with the other.

    I do think they should give the deposit back unless the OP spec'd the car in dynarod orange or something but it'll do them no good really.

    I'm sorry you lost your job. I hope you get a new one soon. I think your doing the right thing by cancelling the car. You don't want the stress of that big debt hanging over you. I understand the garage have a right to keep the deposit but it's bad form really if you have lost your job. Make sure you never go near them again if you are in a position to buy a new car.

    Slightly off topic here, but the employer has no right to hold on to your P45. Ring them tomorrow and tell them if you don't have it by Thursday you'll contact Revenue.

    If they don't give it to you, then ring Revenue and tell them the story, they'll get the P45 off him within two days.

    I suppose from the salesperson it depends what was ordered, if it was a car for sale in the ranks of the top 10 cars in the country in a neutral colour, neutral spec then yes it would have been a good gesture to give full deposit back, if it was a pink Nissan Juke with added orange mirror covers and accessories then no they shouldn't have as they would be stuck with it.
