Took iphone. Consequences?

    Hi,
    I happen to get a iphone from a girl at night worth 250 euros by mistake where I was drunk and forgot to return her in a night out will I go to prison ? I've never used force or deception, the story is very long though, but I've no previous convictions.

    The thing is the phone was like a co-lateral security for the money she and her friend owed me for drinks that night.

    Hard to say what you will get, with so little information about the crime and its consequences. A custodial sentence for a first offence of theft, not involving violence, would be unusual, but is possible. You're motivated here to "talk down" the nature and scale of the offence, but bear in mind that it will be presented very differently in court.

    Plus, prison or no, a theft conviction is a big blot on your record when it comes to future employment prospects, loans, etc.

    If you haven't already done so, get a lawyer and discuss with him your best strategies for avoiding a conviction.

    Get a solicitor. Just because you’ve a summons doesn’t mean you’re guilty. There is obviously more to this as you say the phone was collateral. Theft requires that you took the item without permission, did the other person give it to you in lue of payment of money borrowed or did you take it?

    Don't be an idiot. You've no idea what sort of state the OP is in worrying about a potential prison sentence.

    OP you've very little to worry about in terms of a prison sentence if you get yourself proper representation. You should be able to avail of legal aid.
