    When can the gardai have a prisoner detained in a mental hospital against their will?

    They can't. They can make an application to a gp. The gp then decides if they would recommend an assessment under the mental health act. If yes the gardai can escort the patient to hospital for a period of assessment.

    The situation applys to all people and not just the garda.

    A concerend family member can contact a gp who can do a mental assesment and then make a decision if it is best that someone be brought to a facility for further assesment, how they get there is a different matter
