If the husband built a house on his land and the couple separated, the husband moved out, never divorced and all kids are grown up, out of education but some still lives at home with their mother, in the house their dad built. Who owns the house and land in a situation like this?

Split usually so one could opt for buying the other out for example.

The husband unless it was jointly registered when they married or he transferred ownership when they split, there are a number of possibilities.

The husband may have the legal title but that is damn all use to him. As it was once a family home he needs the written consent of his wife to sell it. if there is a separation or divorce the court can make orders concerning the disposition of the house.

This would be an important consideration - Family Home Protection Act, 1976 http://www.irishstatutebook.ie/eli/1976/act/27/enacted/en/html
