Rights over second hand car within warranty

    Bought second hand 2010 Qashqui in January. Red engine light and emissions light have been coming on regularly. After bringin car back to get sorted, every month since buying it, the emissions light has just come on once but red engine light still happening. I have given them loads of opportunities to fix. Since this week they have been avoiding my callbacks. Have now asked for replacement. Sales guy said "if we can replace it!" Finally mechanic called today asking me to bring it back in to be fixed! Am I entitled to a replacement and or refund?

    It depends on loads of stuff. Also entitlements don't really come into play if you are dealing with cowboys etc.

    What kind of warranty was on the car?
    Has it been the same problem each time?
    Is the warranty from the dealer or a warranty company?
    Was it a main dealer or independent?
    What engine and mileage is the car?
    How much was it?
    Why have you been talking to the mechanic and the salesman? Are they not in the same place.

    If you paid a garage a reasonable amount of money for a car 6 months ago, the car should be right. How you go about what you do next depends on who you are dealing with.

    Yes you are entitled to a replacement or refund as the first attempt to fix it has to be permanent. The fact its been back numerous times is a joke.

    How much was it?€11,500

When he didn't I called to the garage and spoke with a salesperson who promised to ring back that evening but didn't. After sending email yesterday the mechanic finally rang back today.

    Just spoke with garage owner agreed to leave it in next Wednesday and if it can't be fixed.
    My concern is if the engine management light has been coming on then to me there probably will be issues after warranty runs out. Am I entitled to just ask for a replacement as I don't want to risk being left with an unfit car which I will still be paying back in 5 years?

    Too many car dealers are spending literally zero on cars they take in. Engine management light on, no problem just clear the fault code for today. Might last an hour, a day or a week..... who cares as long as it's off for the cash handover.
    Actually getting to the cause of the light is not on their radar.
    There are of course good dealers who put cars right before sale and who will look after warranty issues properly but that does not appear to be the case here.

    you bought an 8 year old car on a five year finance plan? that's quite an act of faith?

    While I agree with you, it wouldn't be so prolific if there wasn't a strong market for it.

    So so many car buyers just want the cheapest way into either the specific model they want or into the reg plate they want and when your buying the cheapest of anything, it's rarely the best.

    I'm not saying this is what happened to the OP but so many people are happy to buy a car from a fly by night portakabin and picket fence outfit because it's say €500 cheaper than the same model with good provenance at a reputable independent or main dealer.

    Ya I've often said it myself - if you can only afford the cheapest example of any model available it's generally not a good idea.
    It is still very easy to be tempted though.

    You can get a replacement or refund. It's up to you and the garage to agree what's acceptable.

    Only if you are dealing with a reputable and established dealer. Some fly-by-night dealer with 4 or 5 cars on display might just disappear overnight. Of course, it could be chased through the courts but that could costs thousands.

    Do fly by nights do finance? You are correct on the hassle if the garage won't play ball but these have taken the car back a few times already so sounds like a legit company.

    Would be surprised if this is a finance deal on the car.

    Not sure which finance house does finance leases on 8 year old cars?

    There would be little equity in that car.
