Car was supposed to be scrapped but..

    Sorry if this has been discussed before, I just can't fit my issue in a short snappy sentence to make good use out of search.

    Back in January my beaten old car failed the NCT for bucket load of reasons, most notably - the frame was corroded and brake system was faulty. The car owed me nothing and I was happy to scrap it. I called up one of the services I found online, a bloke with a trailer picked it up, including the logbook and said he will send a certificate of destruction directly to Shannon.. A faint tone of alarm bells rang in the distance, but not knowing any better, I let him go..

    fast forward - I now received an motor tax reminder and with it - an info that the NCT is due next January.. that potentially could mean any of the following things - 1) someone is driving it, 2) there's an NCT station out there that didn't notice quite significant faults with this car and didn't notice (or didn't want to notice?) that the person bringing the car is not the owner of the car. ... or - 3) Motortax email reminder system is faulty/not representing correct information/making own assumptions?

    if the car would have been involved in any crimes, I would not even know about it, I no longer live in the address where the car was registered at (or my drivers license for that matter)

    any advice what to do? I fired an email to Shannon to see what they say

    no, they want me to fill in a Statutory Declaration in the presence of a Solicitor. It sounds expensive, so I never did it, instead I have a written communication with Gardai.. at least if something happens, I have my behind somewhat covered, whether they will do anything or not is another story..

    Check with solicitor as it may only cost 20 euro to do a phone call could to a few to see price and get the paper work out of you name as the car is still in your name and you would need to prove it was sold for scrap. Do you have any proof of this if it came down to it.

    Just so you know, you're supposed to give the car and the registration cert. to an 'Authorised Treatment Facility' and as poster Dravokivich pointed out, they give you the certificate of destruction. They notify Shannon so as far as you're concerned, that's the end of the matter. You hang on to the certificate of destruction, just in case.

    If you Google 'authorised treatment facility' followed by the name of your county or local authority, you should find a listing.

    no proof whatsoever, to make things worst, I'm quite far away from Ireland with no sure date of when I might be coming back, we are talking months, not weeks, so not sure how the whole solicitor thing can work out..

    just so you know, it's comments like these that are really annoying, I know I made a huge mistake, that's why I'm here asking for any experience of how to deal with the outcome, I don't need a Monday morning quarterback thank you and thank Dravokivich for the same.. :mad:

    This is an open discussion forum, you don't own the thread.

    My motivation for posting was to help others to avoid the mistake you made by outlining the proper procedure to follow, something you might have considered doing but didn't.

    Had a big post wrote out. Changed it to this.

    Contact the solicitor. In the long run, your better off. If car is as bad you say it is and it causes a massive accident, you'd want a galactic distance from it.

    Pay the solicitor, and put it down to experience!

    Personally, always try bring the car to a known facility. I think to some manufacturers take back end of life cars for free. They'll let you know what facility will take the EOL vehicle.

    Get them to recorded it and get a receipt and move on with your life.
    Typical boards scare tactics.

    I once got a knock on the door from two cops saying my car was involved in a robbery/car chase (150km away,4 months ago!!!)
    I went to the station,made a statement and forgot about it.
    I'd say some of the posters here would have been hiring OJ simpsons defence.

    you started your sentence with "just so you know", you couldn't address it more directly to me even if you wanted to. I know this is a public forum and just how you have the right to post here, I have the right to express my annoyance..

    Not sure that'll sort it.

    Assume you wrote to Shannon and they asked for a letter witnessed by solicitor? (Or commissioner of oaths?)

    Had to do similar for customs. My own solicitor did it for free. Said he usually charges 20 to 50 depending on complexity and regular customer.

    The garda report will prob protect from accidents etc. It'll not update Shannon records, tax or nct. Or most importantly M50 toll!!

    Also how you going to guards if not in country?

    Dont panic.
    For e7 send a registered letter to the dealer reminding them that they comitted to sendig the scrap cert to Shannon on X time and asking for confirmation that this has been done. Ask them for a reply in writing in 2 weeks. That way of they 'forgot' it will give them time to do it.

    When you get it you are sorted.

    I got a tax for my old car that had been sold and back in tge day an NCT reminder -I went into a panic but they dont purge their systems every time someone sells a car - thry are not that organised!!

    As a mater of interest I got a frightening letter re notification of 'my car' at my actual address about to be scrapped in their depot unless I paid the seuzure and tow /overnight charges. As my car was outside my door I went to the depot to try and save someone elses car because they had made a mistake. Turns out iy is apparently quite a regular occurance for people to pick a random address and register a car at it and then do tax and insurance online - the fines never get to.you and unless you are stopped at a roadblock you will probably never get caught for outstanding fines(*they must have been unlucky)

    In summary. Go the easy logical route first - cover yourself with a registered letter to the scrap guy. If that doant work try a registered letter to the government dept involved explaining that the car has been sold for scrap to x on Y date and they confirmed they would deal with them directly but are now uncontactable/seem to be put of business. That should cover you.

    Leave the big bucks for later. These are regular things and can be fixed relatively easily without too much cost . Was there a change of ownership cert or did you get a receipt or have a screengrab of their company or address you delivered the car to? Etc. All calm and easy.

    A couple of years ago my car was written off. The insurance company told me to organise to bring it to a particular treatment facility which I did. The insurance company said I didn't need to do anything. Everything would be sorted. I didn't receive any certificate of destruction. Anyway months pass and I start receiving toll ticket letters saying I owed big money. They car was driven around the country roads for a couple of months judging by the dates they used the toll.

    The Motor Tax office told him how to sort it and the Garda will tell him the same?

    Really isn't a big deal here, get the letter signed by the commissioner of oath or solicitor and it's the end of it in your name.

    See lots of these Cars for Cash type 'businesses' on Facebook lately (local trade pages etc), have a banger I need rid of and had been tempted, not now.
    OP if nothing else you have probably saved someone a lot of hassle, hope all goes well.

    If he gave him his car maybe he drove it to his hluse/business so he may have it. Or the guy may have given him a receipt with an address on it. Or the website might have an address. Even I would be reluctant to hand a set of keys to a total stranger on the side of the road with no contact and say there ya are will you scrap yhat for me.

    A "Bloke on the internet" buying scrap cars and then selling them on is not someone who bothers too much with letters or the law.

    For the time, effort and money of chasing all these people they do it officially as they were told how to do it.
