Tip in car park

    So as title says my husband had tip in carpark a few days ago! Both cars were reversing at the time, my huband's was on main passage way and hers out of a space. There is damage to side of our car and damage to her rear bumper! They exchanged details but she was adament about contacting the insurance company as neither accepted liabilty. Guards were not called and no independent witnesses. She is adament about bringing insurance into it! Seems a shame as it was such a minor accident..scratches on both sides. How do these things normally play out? Will it be loss of no claims bonus if we did not plan on claiming but she does :(

    So she reversed into him? If I'm reading this right, she was reversing out of a space, while your husband was reversing into another space? So she just reversed straight back into the side of your car? Sounds like she would be at fault for not yielding to traffic behind. It shouldn't matter that your husband was also reversing.

    If I've read this situation correctly, I would say that she is at fault here. Contact your own insurance company regardless and let them know there was an accident and tell them your side of the story.

    Can you clarify what you man by your husband was reversing on the main passage way? 
    If you mean he was reversing on the main car park road for whatever reason and she was reversing out of her car parking space surely she is at fault as cars on the car park road have the right of way.

    Had an almost identical situation. I offered the guy the option to give me €100 and ill get it fixed.

    He was adamant that somehow it was my fault and insired on letting insurance handle it.

    Luckily i got it on CCTV.

    His insurance deemed him at faault with no uncertainty and paid out €950 :D

    She was definitely at fault as she reversed into your husband as he was already on the main thoroughfare

    The main thoroughfare inside the carpark generally has right of way. The person reversing out of a spot would probably usually be at fault.

    However, it depends on the car park. If it is a one-way system, like some car parks, you would not expect a car to come from your right when you are reversing. Effectively, 2 cars reversing, one out of a spot (not unusual), one reversing down the main road, (not usual).

    I assume he was reversing on the main road part to get back to a spot. The argument could be made that he should have gone round again (up/down etc.) and that reversing against the traffic flow caused a danger.

    I don't know the exact circumstances in this case but whether there was a 1 or 2 way road behind the person reversing has an impact on the fault, IMO.
