Parking ticket summons

    Hi recently received a parking ticket summons for next month.not really the going to court type so my question is do you get a fine in your absence or is it a bench warrant job.can a solicitor represent me for a small fee,knowledgable answers much appreciated

    A summons is a legal demand to attend court.
    Ignore it at your own peril.

    But if you insist on not attending, ensure you have a solicitor present, and a good excuse why you can't/won't attend.

    After that it's in the hands of the judge, and what mood the judge is in.

    If you don't attend court for a parking fine and if the traffic warden or Garda shows up, you will probably be fined €80 or so which means that it makes no economic sense to employ a solicitor. Often the traffic warden will have left the job and they don't show up in which case you will hear no more about it.

    The vast majority of people don't show up, they forgot to pay the ticket and are prepared to take the hit. The suggestion that the judge will be upset if you don't attend a parking court is laughable, it's the exact opposite. They prefer if people don't show up because that way, they get to finish the list of cases faster and might get to go home early. It's a few idiots each day who do show up with a long-winded excuse and who don't know when to STF up that usually get the heaviest fines.

    I didn't realise that parking wardens only last 3 months before they quit.

    And as for the judges mood... well neither you nor I can predict that.
    The judge can go either way.

    Penal warrants have, and are issued for parking tickets.

    (Ie of a Penal warrant: €100 fine, or 2days in prison)

    All fines handed down in the District Court have an option (in default of payment) of a term of imprisonment, why would anyone pay the fine otherwise?

    Get it into your head - nobody employs a solicitor to appear in court for a parking summons and judges in parking courts do not hand down bench warrants for a non-appearance.

    If the OP makes no appearance, he/she will get a letter about three weeks after the court sitting saying that a fine has been imposed and giving methods for payment.

    I have seen bench warrants issued for non attendance in traffic court, even for parking tickets.

    (Your terminology suggests that you aren't too qualified /knowledgeable with the operations of the district court system)

    If youre not the 'type' (whatever that is) to attend court, and youre obviously not the type to park correctly, then why ask?
    Just carry on as you are and if you get a fine/conviction we'll see you back here .

    Getting a parking fine isn't going to get you a criminal record.
    Not turning up in court could be construed as contempt of court though, which could lead to a conviction and a criminal record, even though you're not a criminal.;)
    Or the judge might take your non-appearance personally and issue a warrant for your arrest.
    Maybe best to lie low for a few weeks until they call off the search.
    I say pay the fine now and damn their impudence...:p

    I don’t think I can pay a fine now I think that avenue is closed. Couldn’t care less about criminal conviction to be honest

    'Could be' but never is, especially for minor traffic offences.

    Either the judge proceeds to hear the case in absentia or he/she issues a bench warrant to have you hauled before the court by the Gardai.

    Even if you were summonsed for dangerous driving causing death, all that would happen is that a bench warrant would be issued. And on your first appearance before the judge, there would be no talk of contempt of court.

    I'm advising the op not to ignore a legal demand to attend court.
    And if circumstances dictate that the op cannot attend, then the most prudent course of action is to have a representative there on his behalf.

    Should he personally attend , then there would be no need for a solicitor.

    Btw.. No such thing as Parking Court.
    It's still a district court.

    I forgot about a summons for a parking fine, I got fined €500 for not attending and a €150 expenses in 2009

    If you dont attend court you usually gets a fine, if you dont pay the fine your are summons to attend Court again for non payment, if you don't turn up this time a bench warrant will be issued. There was 16 bench warrants issued at the last Court sitting here in Dungarvan for non payment of fines

    I 'forgot' to pay a parking/non-display of tax fine this time last year...got a summons in the post and rang them, explained I certainly wasn't taking a day off work to pay a fine and they offered to take it over the phone and effectively cancel the summons

    See, this is why clamping is good. Money paid up front, no pssing about with eejits dragging **** out and not paying fines, wasting the time ( and tax money) of courts.

    Just got a ticket today for expired motor tax in free car park had to change to this car (off the road) due to unforeseen circumstances with primary car and I get this well my response is extending my intended time by a month to July before I tax it (baring in mind the risk) f*** them.
