Stamp duty on office with planning for residential

    I am buying apartment and if is currently let out as a office and paying rates as a commercial business but has planning only for a apartment
    Which stamp duty should I pay on it
    6% level or 1 % level as the building is apartment on paper but a office as in use
    I would think it is the 6% level as revenue don’t care about a planning issue
    Any help be appreciated
