CAT obligations for intestate death....

    Hi
    My father in law died intestate ie: did not leave a will. My mother in law was told that she will owe 2k CAT on cash held in a back account in her husbands name. Citizens advice told us a spouse or civil partner has no CAT obligations when it comes to settling the estate regards of weather there is a will or not. As an intestate will my mother in law will get 2/3 of the cash and the rest gets split with the kid's, no problem there. She was told the amount of cash is over the threshhold, my question is are there different tax laws and obligations for estates settles where there is no will.

    What the Citizens Advice Bureau has told you is correct. It makes no difference for CAT purposes whether you receive an inheritance under a will, or on intestacy. The same rules apply to all inheritances. And there is no CAT on inheritances passing between spouses.

    Who told your mother that she will owe 2k on the cash in your father's bank account?
