Court question

    Hi everyone,new here.im in a spot of trouble,im due in court in the coming weeks charged with sec6 of the public order act,it's the 3rd time been called to court for this offence as the last 2 times the case was not listed before the court.i have a previous assault conviction from 11 years ago,I apologized to the Garda and also sent letter of apology to super intendent.im worried sick I'm going to be sent to jail,I was drunk and made a stupid comment and the Garda overheard and I was arrested.i guess my question is,how do I avoid going to prison ? Cheers in advance for and comments.

    How dare you get drunk and misbehave and assault a Garda? You need a hiding. Have you ever wondered why the rest of use exercise restraint and self-control? Perhaps it's time you actually were taught a lesson and you might learn that actions have consequences.

    You can't avoid it. The judge will decide.

    I can't help agreeing with the poster above; occasion No. 1 should have provided the sharp learning curve. Stay away from the gargle.

    Sorry I never assaulted a Garda ,also the comment I made on the night wasn't directed at the Garda

    It can depend on the Judge and area, but with one previous conviction and if you are convicted for this offense it is highly unlikely you'll go to jail, more than likely +- €300 fine

    Sign yourself up for some AA meetings and tell the judge your giving up the beer and it wont happen again . 2-300 euro fine

    I very rarely drink I go out maybe twice a year,I wasn't charged with been drunk,just sec 6

    sorry read wrong section , sign up for some sort of group meetings ( anger etc) i got done for section 6 years back and got an adult caution. Id say youl get away with a fine

    Just when I looked up the penalties it says 3 months is possible hence my worry,just got engaged and have a young baby and this isn't ideal,I know it's my own fault too

    They're unlikely to spend the guts of 25K putting you in prison when it serves no purpose. Get proper legal advice and a legal aid solicitor if nothing else to put your mind at rest and show you're serious.

    No point in worrying about it unless it happens.

    I have solicitor and he said he will try deal with it by way of a fine ..

    Really? In a country where we send paedos to jail for 2 years you want someone imprisoned for making a comment?

    Take yourself into a room and have a talk with yourself.

    Dont sweat it OP. Bring a few bob for the poor box and apologies.
