7 year rule and exempted development

    If a house has had an unauthorised attic conversion but 7 years has passed restricting the council from any enforcement.

    Can you legally still build an extension under 40 meters sq (i.e exempted development) or are you now restricted from doing that due to the attic conversion.

    you cannot benefit from exempted development conditions when unauthorised development exists on site.

    What is unauthorised about the attic?
    Velux to front? Dormer window?

    Also, agree with Syd.

    dormer window on attic. looks out onto the street.

    if sub 40 sq m extension is already built; would you foresee any problems with gaining retention planning to normalise?

    It's the same as saying what's the lotto numbers. You might win, but it's not likely. If I was a planner I'd see that as taking the piss by someone who has little regard for planning rules as you did conversation and went further to build an extension.

    attic conversion was added by previous owner over 20+ years ago.

    Extension was built recently.
