I saw this at NUIGalway the other day. Its the disc on the left that caught my eve and got me wondering . It shows CVRT on it and a quick google gave me Commercial Vehicle Roadworthiness Test (CVRT).

But as you can see from the image, there are 5 seats. Shouldn't this be an NCT disc or are there some sort of exemptions. Can you have a passenger commercial vehicle. I should add that this was a land rover discovery. It looked normal, not even blacked windows. I have removed personal info too from the discs.

depends on the size of the load bay whether you can have a 5 seat commercial I think.

Thats a crewcab model, landrover were selling them directly up till this year. Perfectly legal on a lot of larger vehicles.

    It was an EU directive.

People had commercial 4x4 and were able to put seats in and others already had 5 or 7 seaters and would be able to keep it 5 seater once the boot space was divided by a cage or similar.

Ford kuga can have 4 seats centre seat needs to be removed.

Thanks for the replies. I must say it makes sense for anyone who would have kids to drop off to school/creche in the morning.

It was grand a few years ago but you now must prove its for commercial use.

    Still doesn't stop some.

I do see plenty of 3 seater transits with 6 on board or more and usually full of kids.

Well this had child seats in the back!

no idea,BIK is an unknown quantity to me, but to tax it commercial you have to declare it will be used for commercial purposes only. That always was the case many moons ago when I had a commercial but no-one took any notice of it. Always used mine for the school run but I knew then I wasn't supposed to.

So what exactly do you pay bik on a commercial for then? Genuine question.

You pay 5% BIK on a van if you have personal usage of it, and then it should be taxed privately by the letter of the law.

Those 5 seat commercials are subject to passenger car BIK rates as they are not vans.

'Unenforceable', but has been enforced at checkpoints from time to time.

I didn't say unenforceable (though very difficult to enforce unless you blatantly admit it), I said unenforced. I know an awful lot of people using commercial either partially or only for private/family use and never have I heard of a single person even nearly having a problem.

Cheers. I must mention that in work, there's a few vehicles that would be cheaper tax on private.

It goes to cc rate if commercial...

Would you be insured in that scenario - driving when 'not supposed to'?

The rule isn't enforced. You'd want to some cnut of a Gardai to enforce it. The vast majority of tradesmen i work with use their vans or 4x4's for personal use be it bringing the mountain bikes in the back, going shopping or collecting the kids from school.

Yes, commercial policy's include private use. Never mind people using their own commercial look at how many company owned and branded vans people drive privately at weekends etc.

That's true but look at how many people drink/drive or speed.... the number of people breaking the Law doesn't make it OK
