Neighbours extension

    Hi I built an extension on the house 14years ago and we stepped in 300mm from the boundary fence. My new neighbours have just built an extension and took down the fence and built their wall their. The problem I have is we got a letter of non compliance from the boiler service people and if anything happens to my roof or cutter we have no access to repair it. Any ideas what we should do.

    Civil issue.
    Have you spoke to the Builder or neighbor.

    Have you got a picture of the set up?

    I would consult a solicitor and get them to write to neighbour and builders if known.


    If they have built over onto your property it needs sorted.

    Talk to the neighbour before you go legal. There is no coming back from legal.

    Basically as I said my neighbour has just built an extension and has made the side wall the boundary wall and left me a 300mm gap to fix my gutter or fascia should an problems arise and also the gas company will NOT replace my boiler as their is not enough clearance around the flue because of the wall and no access to seal it.

    It's a tough one OP - look up TGD J. Table 5 - Dimension H - Appears to say that your flue should not have been installed any closer than 600mm to the boundary. It seems you installed it at 300mm from the boundary.

    Separately from this the neighbours built right on top of the boundary - which as far as I'm aware is legal, but I'm not sure under what circumstances. There have been a few threads about that previously on this forum, they list the specific regulations. Have a search for "boundary wall" or terms like that. Either way - it would have been nicer if they talked about it with you first!
