Who owns what ???

    Iv farmed all my life on home farm. My father left me 2 thirds of farm and kept 1 third year's ago for himself. I have a sister that did not talk to me or my father when that transfer was done but my father had set her up well with education and she has very good job . She still does not talk to me or him .
    My father is in hospital at the moment and does not have long left to live and is unconscious. The part that my father had kept back I think he has left some of it to her so he had told me before he went unconscious and he wanted to change it. The thing is my father gave me his part rent free and I have been sowing crops in it the last number of years . I have a crop in these fields at moment so would I still get to keep these crops if father dies now. Harvest is August for this crop.

    She will either have to allow you harvest the crop or pay you for the value of it

    I'd say it will take 9 months plus to sort out the will at the earliest, will be harvested then.

    Sorry the hear about your dad.

    Isn't there something about a years probate where nothing can be sold? You're best to chat to a solicitor.

    Never rented it off him , He just let me farm it over the last 7 years . I offen gave him a cheque but he would never lodge it to his account and told me he didn't want anything for it.

    It will probably be up to the executor, but forget about it for now and spend time with your father.

    Sorry to hear about your Father. If he is still alive I don't think it's too late yet, talk to a solicitor about changing his will. I don't know what the legalize is for the exact term, if your father wishes to change a will, but is physically incapable. The worst that can happen is that your sister might contest it, if a new will gets made.

    If the seat's wet, sit on yer hat, a cool head is better than a wet ar5e.
