End of a fixed term contract

    I have a fixed term contract which ends at the end of January.
    My notice within that contract is 2 months. I must give 2 months notice.
    I want to leave but my employer wants to make me stay.
    I did not mention at the end of November that I did not want to renew my contract as I thought that given the contract states that my contract finishes at the end of January that there was no need.
    My employer now states that given that it is now 5 weeks until the end if January that I have to work the first 3 weeks if February to serve my notice.
    I thought that because it was a fixed term.contract with a written finish date of the 31st January that there was no need.
    Who is correct Here?

    Chancers, your contract ends at the end of January, no notice required. Notice would have been required if you wanted to end the contract early.

    How you handle this though is up to you, if you need a good reference, then work the few extra weeks (you'll be getting paid for them, so not the worst thing to happen)
