Tax credits - SPCC and rent tax credits

I have an 11 year old son with an ex-girlfriend. He stays with me weekends (3 days a week) and I pay maintenance (not court ordered). I am single, and not co-habiting (We separated 10 years ago). I know, in the past, you could claim loan parents tax credits at an insanely low threshold (A couple of days a year I think) and this entitled me to quite a large tax refund in 2010. Other than the 4 years I claimed for for that refund, I have been claiming a single person tax credit.

I have been looking at the SPCC credit that replaces the old lone parents credit, and I wonder could one of you help me with a question I have about it. I know that it's possible for her to relinquish her claim and allow me to use the tax credits (I qualify as my son is with me ~150 days a year). She does not work, and is on social welfare, will this affect her ability to claim that etc?

Also, I know it ends this year, but the rent tax credits, revenue specifies that you must have been renting on 7th December 2010. Does that require that you were renting the same place continuously from 2010 - 2017? I was renting on that date, but it was a different location (in a different county).

    Thanks in advance.

Your ex can relinquish the SPCC..

Your ex should complete form SPCC1 and you should complete form SPCC2 (or maybe the other way around...can't remember)...both downloadable at revenue.ie. Not sure if you can do it online...but I'm sure one of the other regulars here will know....

Once you were renting on that date in 2010, no matter how many times you've moved since, you qualify for the rent credit which will soon be gone...it was abolished in the budget announced at that date, so the credit would not be due to anyone who hadn't been renting at that time.
