Traffic fine/court

    I received a fine for no L plates and no full licence driver and the deadline to pay is in a couple of days.
    I got a parking fine before and I never paid it and received a court summance that said if I paid the fine 7 days before court date I didn't have to go to court.
    What I'm wondering is with the traffic fine if I don't pay by the certain date and get a court summance , will it give me the option of paying it 7 days before court like the parking fine or will it just be a straight out court date ?

    Pay the fine asap, your only creating more trouble for yourself by ignoring it. You got a lucky break with the parking fine but an actual road traffic offences are a different story.

    Parking fines are often issued by the council, not the Garda, so different procedures apply.

    You have 56 days from the date on the notice to pay, the fines will increase by 50% after 28 days however.

    If you don't pay by 56 days a summons will be issued for the local district court.

    The law has changed,but i am unsure if it is enacted yet.

    With the Gardai at least, if they turn up at your door with a summons you will get one final opportunity to pay the fine before it goes to court.

    What you should be aware of is, if you get this option the fine will be double the original.

    The 7 day option, officially know as a "Section 44 Notice", but generally referred to as the 3rd payment option applies to any offences committed on or after 1st June 2017.

    As Cork Truck Driver points out exercising this option will see the fine double.

    If the offence happened up to 31st May 2017 you can't avail of the 7 day option, if it happened on or after 1st June 2017 you will be afforded the option.

    I do want to pay the fines I'm just trying to stretch it out until after Xmas . I just want to know do I get time before I have to go to court .

    Here is the list of penalty point offences as of April 2016.

    If you go to court and are convicted you WILL get a higher number of points

    When you exercise the 3rd payment option you get the lower penalty points, same amount as had you of paid the fine within the 56 days.

    You will get double the points if you wait until conviction. 4 points will be applied when paying the fine or 8 if you wait for court.

    You are still only a learner and close to going to court twice for driving offences. You are not going to avoid this, so stop delaying it and just pay the fine now.

    Assuming both offences happened at the same time the OP would only get 2 points when paying the fine or 4 upon conviction.

    Parking fines don't incur points (except dangerous parking).

    Below is what we are talking about:-

    Or €420 and 2 points if 3rd payment option is exercised.

    Yes, the offences are punished by a fine AND penalty points. As a learner you have a lower points threshold before you're put off the road so don't risk double points. Oh and obey the law, it's cheaper that way ;)

    Ooooh didn't know that! I thought 12 was quite a low number as it is. But its a good way of doing it I suppose. If someone manages to get themselves that many points before they get their full licence, they probably don't deserve to drive.

    Thank god I have a clean licence! :)

    It was 12 across the board at 1 time but they changed it.

    Learners are on very thing ice where financial penalties carrying points are concerned.

    I think 12 is very generous in fact, in some circumstances you could get caught 6 times before being put off the road and even then I bet you could plead hardship and get off a ban in Court.

    Increasing the points per offence might be something that would clamp down on the generosity.

    For example:

    Speeding 5 points?
    Mobile Phone 5 points?

    Something along those lines?

    Some might hammer my suggestion and i can relate to why.

    But to be fair,even in its current format of 3 points for speeding you would need to be caught 4 times to have a ban imposed for a fully qualified driver.

    A learner is 2 strikes for the same and out.

    A learner is 2 strikes for the same and out.

    3 strikes for a learner for the same. Automatic ban for a learner/novice is 7 points, not 6.

    Just be honest with them. Tell them you're happy to pay the fines but ask them if they'll take a deposit now and if you can pay after Christmas because you need to buy presents for people.

    You'll get your answer quickly.

    What about Christmas is more important than paying a fine on time and risking conviction?

    I wouldn't be able to get a notice and wait two feckin months before paying.

    This country is almost always lagging behind the UK when it comes to important legislation.

    Your proposal is very stiff but i don't see many people disagreeing with you on that.

    I back it 110%

    At the rate phone use while driving is going it'll have to be an instant ban if caught.

    Driver should also be made to drive slowly over their phone. With the window down, so they can hear the crunch. Twice, to make sure. Then they should be made sweep up the mess, take it home, and put it in the bin.
