Planning Permission for a 2nd Storey

    I am in the process of buying an end of terrace house. The gable wall and the side of the back garden leads onto a laneway. We would like to build a two storey extension at the rear as soon as we can. I don't really want to wait the 8 weeks (and 2 mortgage payments!) for planning permission.

    I'm a little confused by the guidelines on the DCC site:
    "Can I build an extension to my home without having to seek planning permission?
    Broadly speaking, the construction of an extension or conservatory does not require planning permission when it is to the rear of the house...

    The following should be seen only as general guidelines;

    Terraced and Semi-Detached Houses: ... Any above ground floor extension shall be a distance of not less than 2 metres from any party boundary."

    We will be under the 40 sq metres (and the 2nd storey extension will only be 6/7 sq metres). It will also be on the laneway boundary and more than 2 metres away from our neighbour wall on the other sided. The laneway is over 2 metres wide and then it's the next houses garden.

    My question is... Is the laneway side a boundary wall or is it considered a 'party boundary' wall? Do i need planning permission?

    Party wall and boundary wall can be the same thing.
    You need planning for what you describe unless you keep the walls 2m from both boundaries and also the floor area under 12 Sq. M.

    You are also restricted by windows placement and the height of the second storey.

    The extension shall not reduce the "Private Open Space" of the back garden to less than 25 sq. m. Hard surface areas to the rear of a house are exempted development, providing they are used for a purpose incidental to the enjoyment of the house and not used for the parking of cars.
    N.B. Existing or proposed garden shed/s are not reckoned as private open space
